02What this policy covers

This policy explains how we handle personal data when you visit byteshark.in, contact us, book a call, apply to work with us, buy our services or interact with our ads. It does not cover websites or apps run by others that we link to, such as WhatsApp, Instagram or LinkedIn, which have their own policies.

03Information we collect

Information you give us

• Your name, email address, phone number, company name and anything you write to us, when you email, call or message us on WhatsApp or book a strategy call.
• Your portfolio links, CV and any details you share when you apply to work with us.
• Billing details such as your name, company, address and GST number when you buy our services.
• Brand assets, briefs and business information you share with us so we can deliver our services.

Payments

Online payments are processed by our payment partner, Razorpay. We never see or store your full card number, CVV, UPI PIN or banking passwords. We receive the transaction details we need for our records, such as the amount, date, payment status and the last digits of the card or the payment method used.

Information collected automatically

• Technical data such as your IP address, browser, device type and the pages you visit, kept in our hosting provider’s server logs for security and troubleshooting.
• With your consent only, data collected by cookies and similar technologies such as the Meta Pixel and Google Analytics, which help us measure our ads and understand how the site is used. See our Cookie Policy.

“Ask Sharky”

Questions typed into the “Ask Sharky” box on our homepage are answered inside your browser and are not sent to or stored by us. If you choose the option to continue the conversation on WhatsApp, your question is pre-filled into a WhatsApp message that you can review before sending.

04How we use your information

• To reply to your enquiries, book and run strategy calls, and send proposals.
• To deliver the services you buy, including managing projects, campaigns and revisions.
• To take payments, issue GST-compliant invoices and keep accounting and tax records.
• To review job applications.
• With your consent, to measure and improve our advertising and to show you relevant ads.
• To keep the website secure, prevent fraud and fix problems.
• To comply with the law and respond to lawful requests from authorities.

05Why we are allowed to use it

Under India’s Digital Personal Data Protection Act, 2023, we process your personal data on the basis of your consent, or for legitimate uses permitted by the Act, such as when you voluntarily give us information for a specific purpose (for example, asking for a proposal) or where processing is needed to comply with the law.

If you are in the European Union or the United Kingdom, our legal bases under the GDPR are: performing a contract with you or taking steps at your request before one; our legitimate interests in running and improving our business; complying with legal obligations; and your consent, for analytics and advertising cookies.

You can withdraw your consent at any time. This does not affect processing that happened before you withdrew it.

06Who we share it with

We do not sell your personal data. We share it only with:

• Service providers who help us run the business, including Razorpay (payments), Meta Platforms (WhatsApp and, with consent, the Meta Pixel), Google (email, workspace tools and, with consent, Google Analytics), our website hosting provider and the creative and AI tools we use to deliver your projects. They may use your data only to provide their services to us.
• Professional advisers such as accountants, auditors and lawyers, where needed.
• Authorities such as tax authorities, regulators, courts or law enforcement, when the law requires it.
• A buyer or successor if our business is reorganised, merged or sold, under the same protections.

07International transfers

Some of our service providers store or process data outside India, for example in the United States or the European Union. Where we transfer data abroad, we do so only to countries not restricted by the Government of India and, for EU and UK visitors, with appropriate safeguards such as standard contractual clauses.

08How long we keep it

• Enquiries that do not become projects: up to 2 years after our last contact.
• Client, project and billing records: for as long as needed to provide the services, and then for the period required by Indian tax and company law (generally 8 years for accounting records).
• Job applications: up to 1 year, unless you ask us to delete them sooner.
• Analytics and advertising data: according to the retention settings of the tool, and no longer than 26 months.

09How we protect it

We use reasonable security practices, including encrypted connections (HTTPS), access controls and reputable providers, to protect personal data. No method of transmission or storage is completely secure, but if a personal data breach affects you, we will notify you and the relevant authorities as the law requires.

10Your rights

Depending on where you live, you have the right to:

• ask for a summary of the personal data we hold about you and how we use it;
• ask us to correct, complete or update it;
• ask us to erase it, where we no longer need it or you withdraw consent;
• withdraw consent at any time, including for cookies, through the “Cookie settings” link in our footer;
• nominate another person to exercise your rights if you die or become unable to;
• raise a grievance with us, and if it is not resolved, complain to the Data Protection Board of India.

If you are in the EU or UK, you also have the right to data portability, to object to processing based on legitimate interests or for direct marketing, and to complain to your local data protection authority.

To use any of these rights, email our Grievance Officer (details below). We may need to verify your identity, and we will respond within 30 days.

11Children

Our website and services are meant for businesses and adults. We do not knowingly collect personal data from anyone under 18. If you believe a child has given us personal data, please contact us and we will delete it.
