01About these terms
These terms apply when you use byteshark.in (the “website”) or buy services from Byteshark Private Limited (“ByteShark”, “we”, “us”). By using the website or our services, you agree to them. If you are agreeing on behalf of a business, you confirm you are authorised to do so.
Where we sign a separate proposal, statement of work or agreement with you, that document applies to the project and takes priority over these terms if they conflict.

02Our services and plans
We provide AI-powered marketing services, including ad creatives and AI video, performance marketing, automations, branding, content and websites. Our monthly plans and what they include are described on our Pricing page. Custom work is scoped in a written proposal.
Delivery times shown on the website (for example, “7–10 business days”) are typical estimates, not guarantees. They depend on the scope of the work and on you sharing briefs, assets and feedback on time.
03Prices and payment
- Prices on the website are shown in US dollars and exclude applicable taxes. For clients in India, GST is charged at the applicable rate and shown on the invoice.
- Monthly plans are billed in advance for each billing cycle. Custom projects are billed as set out in the proposal.
- Online payments are processed securely by Razorpay. By paying, you also agree to Razorpay’s terms.
- If a payment fails or is overdue, we may pause work until it is settled.
- Refunds and cancellations are covered by our Refund, Cancellation & Delivery Policy.
04Your responsibilities
- Give us accurate information about your business, products and audience, and respond to requests for feedback within a reasonable time.
- Only share logos, images, footage, music, product claims and other materials that you own or have permission to use, and let us use them for your project.
- Review and approve deliverables before you publish or advertise them. You are responsible for the claims your ads make and for following the rules of the platforms you advertise on.
- Keep any login details you share with us for ad accounts or tools secure, and tell us if they change.
05Ownership of the work
Once you have paid in full for a deliverable, you own the final deliverables we create specifically for you and can use them for your business.
We keep ownership of our pre-existing materials, tools, templates, prompts, workflows, know-how and anything not made exclusively for you. Where final deliverables include licensed elements such as stock media, fonts or music, they are subject to those licences.
Unless you ask us in writing not to, we may show work we have created for you in our portfolio, case studies and marketing after it has been published.
06AI-generated content
We use artificial intelligence tools to create images, video, copy and other content. AI outputs may not be unique, and similar outputs may be generated for others. Intellectual property protection for AI-generated material varies by country and may be limited. We review our work carefully, but you should check deliverables, including any likeness, claims and product details, before publishing them.
07Spec work and other brands
Some work on this website is labelled “spec work”. These are concept pieces we made on our own initiative to show what is possible. They were not commissioned by, and do not imply any endorsement by or affiliation with, the brands shown. All trademarks belong to their respective owners.
08No guaranteed results
Marketing results depend on many things outside our control, including your product, pricing, market, budget and the algorithms and policies of advertising platforms. We work hard to grow your business, but we do not guarantee any specific results, such as sales, leads, return on ad spend or rankings. Any figures we share from past work are examples, not promises.
09Using the website
- Don’t misuse the website, for example by trying to hack it, overload it, scrape it in bulk or use it for anything unlawful.
- The content, design, code, Sharky mascot and branding on this website belong to us or our licensors. Don’t copy or reuse them without our written permission.
- The website may link to other websites. We are not responsible for their content or practices.
- We try to keep information on the website accurate and up to date, but it is provided “as is” and may change without notice.
10Confidentiality
We will keep your non-public business information confidential and use it only to deliver our services, except where we need to share it with our service providers under similar obligations or where the law requires it. Please keep our proposals, pricing quotes and working methods confidential too.
11Limitation of liability
To the extent the law allows, we are not liable for any indirect or consequential loss, or for loss of profits, revenue, data or goodwill, arising from the website or our services.
Our total liability for any claim relating to our services is limited to the fees you paid us for the services in the three months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.
You agree to compensate us for losses arising from materials you supplied to us that infringe someone else’s rights or from claims made in ads you approved.
12Ending our work together
You can cancel a monthly plan as described in our Refund, Cancellation & Delivery Policy. We may suspend or end our services if you seriously breach these terms, including non-payment, after giving you notice and a reasonable chance to fix the problem where possible. Sections on ownership, confidentiality, liability and governing law continue to apply after our work ends.
13Governing law and disputes
These terms are governed by the laws of India. We will always try to resolve any disagreement with you informally first. If we can’t, the courts in Kolkata, West Bengal will have exclusive jurisdiction.
14Changes to these terms
We may update these terms from time to time. The version on this page, with its “last updated” date, applies from the date it is published. Changes do not affect work already agreed under a signed proposal.
